The Contract Compliance Section implements City Ordinances 78-1538, 85-2070, and 85-2071. This section develops the labor compliance language for all construction bids and contracts, and enforces the Equal Employment Opportunity and Prevailing Wage sections of these contracts through the audit of payrolls and other contractor documents and through on-site visits, which include interviews with construction workers. In addition, Contract Compliance Officers investigate affidavits from workers alleging wage underpayment.
Under Ordinance No. 78-1538, it is the responsibility of the Contract Compliance Section to insure that wage standards and regulations are met on all construction contracts with federal, state, and City funding. Presentations are made at all pre-construction conferences and meetings to explain the compliance guidelines to contractors and to answer any questions about compliance requirements. The section sponsors workshops to assist contractors' payroll personnel in meeting all labor compliance standards and requirements.
Under the Ordinance, the Affirmative Action Director is authorized to issue Notices of Show Cause for non-compliance with prevailing wage rates, followed by letters of Recommended Sanctions to contractors who do not comply. The section participates with the Public Works and Engineering and the Aviation Departments in the final evaluation and payment process on construction projects.
Contract Compliance staff monitor MW/DBE activity on City construction, contracts with MW/DBE goals. During final close out of each construction contract with an MW/DBE goal, the section verifies payments to MW/DBEs. A new MWDBE Management system has been implemented to monitor all MWDBE utilization and verification of payments online. The web-based software system is available to all City departments, MWDBE's, and contactors.
