Driving Safety Course
The Code of Criminal Procedure, Art. 45.0511(q) states: "You may be able to require that this charge be dismissed by successfully completing a driving safety course or a motorcycle operator training course. You will lose that right if, before your appearance date, you do not provide the Court with notice of your request to take the course."

You must request (DSC) Driving Safety Course) or MOTC (Motor Operators Training Course) before your arraignment setting (first setting) or you will lose the right to elect it at a later time. It is too late to elect DSC/MOTC at the trial.

Please allow 10 days from the date the ticket was issued to make your request in person.

Deferred Disposition
Deferred disposition is a suspended sentence. On your plea of guilty or no contest, the Court will defer a finding of guilt, assess Court costs, and order that you post a bond and comply with certain conditions. If you successfully comply with the terms, your case will be dismissed, and the bond money will be applied to a special expense fee. If you fail to comply with the terms, a judgment will be imposed, a conviction will be reported to DPS (Texas Department of Public Safety), and the bond money will be applied to the fine. Discretionary Driving Safety Course
If you do not qualify or are not eligible to take the Driving Safety Course (DSC) or Motorcycle Operators Training Course (MOTC) because:

  • You have successfully completed a course within 12 months preceding the date of this new citation for the purpose of having a ticket dismissed , OR,
  • You failed to request the course on or before your arraignment setting (initial Appearance),

You may request, in court, that the Judge grant you the opportunity to take a Discretionary Driving Safety Course. The Judge is not obligated to grant this request.

Plea of “Not Guilty” By Mail
You have a right to a jury trial, unless you give up that right and request a judge trial. By setting your case for trial you are giving up your right to require that your case be dismissed through a mandatory Driving Safety Course.
