December 25, 2005 -- Houston police are investigating the aggravated assault of a woman and two police officers (with a deadly weapon) at 9305 Rosehaven on December 24, 2005 about 4:30 a.m.

The victim is identified as Pamela Foston, 42, of the 5300 block of Myrtlewood. She sustained grazing gunshot wounds to the head and arm. Foston was transported to Ben Taub General Hospital where she is in stable condition and is expected to recover from her injuries.

The suspect is identified as Theolonious Paul Henry (b/m DOB: 3-13-65), of the 5300 block of Myrtlewood. He sustained multiple gunshot wounds to his upper torso. Henry was transported to Memorial Hermann Hospital and he remains in critical condition.

HPD Homicide Division Sergeant E. Gonzales and Officer R.P. Martinez reported:

Foston and Henry were previously dating but recently they had problems. Foston was staying with an acquaintance at 9305 Rosehaven. Henry arrived there looking for her and began assaulting her. When the police arrived, they observed Henry striking Foston and pointing a pistol at her. They saw Henry shoot at her and then turn around to point his pistol at the officers. Fearing for their life and that of Ms. Foston the officers shot at Henry. At this time, no charges have been filed against Henry.

As in all officer-involved shootings, the HPD Internal Affairs and Homicide Divisions, and the Harris County District Attorney's office are investigating this incident.
