Officer S. Frank, a four-year-veteran and Officer D. Carter, a two-year-veteran, assigned to the North Patrol Division initiated a felony traffic stop of a Dodge Intrepid. This vehicle was stolen in an aggravated robbery at 9900 Hempstead Highway approximately 30 minutes prior to the traffic stop. The victim of the aggravated robbery observed the stolen vehicle driving off with a black Ford truck following. Uniformed HPD Officers J. C. Oliver and F. J. Heenan, also assigned to the North Patrol Division, assisted the officers in the felony traffic stop As the officers took the juvenile female driver of the Dodge Intrepid into custody they observed the black Ford truck approach the officers. Officers Frank and Oliver issued verbal commands for the truck to stop and turn off the engine. The driver of the Ford truck,
later identified as Jonathan Villarreal, ignored the officers' verbal commands. Villarreal backed the truck up into a residential driveway and then accelerated at Officer Oliver. Responding to the deadly threat to Officer Oliver, Officer Frank fired one shot striking the passenger side of the suspect's vehicle as it passed in front of him. A vehicle pursuit followed and Villarreal was seen throwing what appeared to be a handgun from the vehicle. Villarreal drove into an apartment complex located at 4211 Sherwood Lane striking two unoccupied cars in the parking lot. Villarreal fled on foot
