January 9, 2006 -- The Harris County Medical Examiner's office has identified the victim in a fatal shooting murder that occurred at 4700 Cherbourg on Saturday, January 7, 2006 about 1:20 a.m. as 14-year-old Xochilt Diaz of 5333 Wellington, Austin, Texas.

Two suspects arrested in this incident, Gilbert Rodriguez IV (H/m, DOB 6/26/82), of 2310 Welk and Julio Armando Falcon, (H/m, DOB 4/1/85), of 2200 Theta have both been charged with capital murder in the 183rd State District Court.

HPD Homicide Division Sergeant M.W. McStravick and Officer I.F. Flores reported that Ms. Diaz was at the residence of Rodriguez when she became involved in an argument with for boyfriend, Julio Falcon, Rodriguez and his wife. The suspects forced Ms. Diaz into the trunk of Rodriguez's vehicle and then drove away. Diaz managed to escape from the trunk at 5300 Bataan; however, she was recaptured and forced back into the trunk. The suspects drove to 4700 Cherbourg where Julio Falcon shot Diaz in the head and dumped her body in the roadway. HPD patrol officers later arrested the suspects.
