April 4, 2008 - Houston police will refer the fatal shooting of a robbery suspect by a business owner at 2525 Broadway about 11:50 p.m. on Thursday (April 3) to a Harris County grand jury.

The suspect suffered a gunshot wound to the head and was pronounced dead at the scene. His identity is pending notification to family members by the Harris County Medical Examiner’s Office.

A second suspect is still at large and is described as a Black male, 19 to 22 years of age, 5 feet, 11 inches tall and a medium build. He was wearing a long sleeved black hooded sweatshirt, black ski mask, black gloves, and blue jean shorts. He was also armed with a black semiautomatic weapon.

The complainant, Peter Quang Dan, 50, was struck in the head with a pistol but was not injured.

HPD Homicide Division Sergeant J. Rubio and Officer B.D. Evans reported:

Officers responded to a robbery call at the Colony Express Market at 2525 Broadway and found the deceased suspect lying on the sidewalk with a gunshot wound. Mr. Dan stated the suspect, along with a second armed suspect entered the store and demanded the contents of the cash register at gunpoint. The suspect then pistol whipped Dan and ordered him to put his hands on his head and lie down on the floor. As the suspect fled with the money from the cash register, Dan retrieved his weapon and fired a shot at the suspect as he exited the store. The suspect collapsed on the walkway just outside the store.

No charges have been filed at this time.
