Suspects Arrested, Charged in Fatal Shooting at 798 Maxey

April 23, 2008 - Charges have been filed against three suspects arrested in the fatal shooting of one man and wounding of another at 798 Maxey about 8:50 p.m. on April 14.

The suspects, James Edward Probst (w/m, DOB: 2-15-90), Debbie Ann Probst (w/f, DOB: 4-9-74) and Elizabeth Lurene Smith (w/f, DOB: 6-23-85) are charged with capital murder in the 183rd State District Court. They are accused in the killing of Cesar Alvarado, 26, of Houston. Alvarado suffered a gunshot wound to the chest and was pronounced dead at the scene.

A second victim, Jesus Garcia, 22, suffered a gunshot wound to the back and was transported to Ben Taub General Hospital in stable condition.

HPD Homicide Division Sergeant C.M. Cegielski and Officer B.W. Nabors reported:

Alvarado and Garcia cashed their payroll checks in the PL$ Check Cashers business at 798 Maxey and were getting into their vehicle in the rear parking lot of the business when James Probst approached them. Probst attempted to rob the victims at gunpoint and shot both Alvarado and Garcia.

Further information identified James and Debbie Probst and Elizabeth Smith as suspects in this case and all three were arrested at separate locations on Monday (April 21).
