Investigation into Fatal Shooting at 1701 Upland

May 8, 2009 - The fatal shooting of a burglary suspect at 1701 Upland about 10:05 p.m. on Thursday (May 7) will be referred to a Harris County grand jury. 

The suspect, Fernando Hidalgo Vives (H/m, DOB: 5-5-80), of Houston, suffered a gunshot wound to the chest and was pronounced dead at the scene. 

The male victim (shooter), 55, was not injured in this incident. 

HPD Homicide Division Officers T. T. Pool and M. Khan reported: 

The victim and his girlfriend were inside of his apartment when someone knocked on the door.  The girlfriend opened the door and found it was her ex-boyfriend, Vives.  Vives then pushed his way into the apartment and walked towards the back while the girlfriend tried to stop him.  The victim, who had a pistol in his hand, then told Vives to get out of the apartment.  Vives continued to approach the victim and then struck him twice with his fist.  At that time, the male victim shot Vives.  The girlfriend was not injured in this incident.
