Motorist Charged in Fatal Traffic Accident at 10400 North Freeway

January 19, 2010 - Charges have been filed against a motorist arrested in a fatal traffic accident at 10400 North Freeway (Interstate Highway 45 North) about 6:25 p.m. on Sunday (Jan. 17).

Marisa Kristine Whitenton (w/f, DOB: 11-26-88) is charged with intoxication manslaughter in the 248th State District Court for her role in the death of Anne Gardner, 54, of Cypress, who was pronounced dead at the scene.

HPD Vehicular Crimes Division Sergeant E. Spencer and Officer C. Sartor reported:

Whitenton, driving a tan Honda CRV, and Ms. Gardner, driving a gray Mazda 3, were traveling northbound in separate lanes on the North Freeway when Whitenton drove into Gardner's lane and struck her vehicle. Gardner's vehicle left the freeway and struck a light pole while Whitenton's vehicle went off the freeway, struck a tree and then rolled over. Paramedics pronounced Gardner dead at the scene and transported Whitenton to Memorial Hermann Northwest for minor injuries. A mandatory blood sample was taken from Whitenton at the hospital and she was charged.
