Investigation into Fatal Shooting at 5709 Allison Road

May 6, 2010 - The fatal shooting of an armed suspect at 5709 Allison Road about 9:50 p.m. on Wednesday (May 5) will be referred to a Harris County grand jury.

The suspect, Marlin Joe Brown (w/m, DOB: 12-26-42) suffered a gunshot wound to the upper torso and was pronounced dead at the scene.

The male shooter, 55, was not injured in this incident.

HPD Homicide Division Sergeant R. Torres and Officer J. Harvey reported:

Brown, who is the landlord and employer of the male, confronted the male in his residence regarding an alleged sexual relationship between the male and Brown’s girlfriend. Brown then began assaulting the male. When the male pushed him outside, Brown told him he was going next door to get his gun. The male then grabbed his shotgun and ran outside to hide under a trailer. Brown returned and began shooting towards the male and into the male’s residence. The male returned fire and fatally struck Brown.

The male and witnesses were questioned and released at the scene.

No charges have been filed at this time and the investigation is continuing.
