Investigation into Incident at 16031 Clarke Springs Drive

June 4, 2013 - Charges have been filed against two suspects arrested in an incident in which a Houston police officer discharged his duty weapon at 16031 Clarke Springs about 8:40 p.m. on Sunday (June 2). 

One male suspect, 14, is referred to Juvenile Probation authorities on a charge of unauthorized use of a motor vehicle and felony evading in a motor vehicle out of the Fort Bend County District Attorney's Office.  The other male suspect, 15, is referred to Juvenile Probation officials on a charge of evading on foot, also out of Fort Bend County. 

Officer M. Rivera, who discharged his duty weapon, was not injured in the incident.  Officer Rivera was sworn in as an officer in March 2009 and is assigned to the Southwest Patrol Division. 

HPD Homicide Division Sergeant J. French, Senior Police Officer M. Khan and Officer I. Ulloa reported: 

Officer Rivera attempted to conduct a traffic stop on a stolen van in the 16000 block of Clarke Springs Drive.  The driver initially refused to stop, eventually drove off-road and came to a stop in an area behind a residence in the Fort Bend County limits.  As the vehicle came to a stop, several suspects exited and fled on foot.  Before Officer Rivera could exit his patrol vehicle, he saw one male passenger pointing a rifle toward him.  Fearing for his ife, Officer Rivera discharged his duty weapon at the suspect but did not strike him.  The suspect then fled on foot.  Additional HPD patrol officers responded to the scene and managed to take two suspects into custody. 

Further investigation identified the 14-year-old suspect in custody as the driver of the stolen vehicle.  Additional information obtained determined the 15-year-old suspect was also involved in the incident.  The armed suspect has not been identified and remains at large.
