Investigation into Fatal Shooting at 7518 North Freeway

September 12, 2013 - The fatal shooting of one robbery suspect and wounding of another at 7518 North Freeway service road about 9:25 p.m. on Tuesday (Sept. 10) will be referred to a Harris County grand jury.  

The deceased suspect, Melvin Frederick Austin (b/m, DOB: 12-8-87), was pronounced dead at the scene.  The other suspect, Elijah Alexander Mims (b/m, DOB: 3-22-81), is charged with aggravated robbery with a deadly weapon in the 262nd State District Court.  Mims was found at a College Station hospital emergency room with a non life-threatening gunshot wound.  

Photos of both suspects are not available for release at this time.     

The male shooter, 29, was not injured in the incident.  

HPD Homicide Division Sergeants R. Torres and T. Richardson reported:  

The male victim was parked in front of a restaurant at the above address and using a DVD rental kiosk when he was approached by Austin and Mims, who were armed with guns.  The suspects demanded the victim's car keys and cell phone and then got into the victim's vehicle to steal it, while a third unknown suspect fled in a 1999 dark green Honda Civic.  As the two suspects turned to back away in the vehicle, the victim, who is a concealed handgun license owner, pulled out his gun and fired at both suspects through the driver's side window and front windshield.  Austin was struck and died at the scene.  Mims was also struck and then fled on foot.  He was then picked up at another location by the third suspect in the Honda Civic.  

Mims was dropped off at a hospital emergency room in College Station, Texas, where doctors called local police.  College Station police offciers responded and took the suspect into custody.  HPD homicide investigators interviewed Mims in College Station regarding his involvment in the incident. The green Honda has been recovered.
