Investigation into Incident at 3409 Cavalcade


June 7, 2016 - Houston police are investigating an incident in which an HPD officer discharged his duty weapon, striking an individual, at 3409 Cavalcade about 1:10 a.m. today.

Earl Wayne Brown, 48, suffered a gunshot wound and was transported to Memorial Hermann Hospital.  The wound is believed to be non-life threatening.

The officer who discharged his weapon, Sergeant K. Green, was not injured in this incident.  He was sworn in as an officer December 1984 and is assigned to the Burglary and Theft Division.

HPD Homicide Division Sergeant J. Horn and Officers S. Gromyko, T. Jackson and S. Overstreet reported:

The sergeant was working an approved extra job at Mr. A's Club at the above address when he was advised of a physical altercation between multiple males in the back porch area.  The sergeant, and another officer providing security at the club, went to investigate.  As they entered the room, they observed several males fighting, with multiple bystanders present.  When the sergeant attempted to halt the fight, he observed one of the males involved in the fight reach into his waistband as if for a weapon.  Fearing for the safety of others and himself, the sergeant drew his duty weapon.  As he did so, the crowd pushed Mr. Brown forward and he fell into the sergeant's duty pistol that then discharged, striking him.  The bystanders and the individuals who were fighting then fled the scene.  The sergeant rendered first aid to Brown until Houston Fire Department paramedics arrived.

As is customary in officer involved shootings within the city limits, this case is being investigated by the HPD Homicide and Internal Affairs Divisions as well as the Harris County District Attorney's Office.
