Suspect Arrested, Charged in Shooting Incident at 5000 West Alabama


January 25, 2017 - Charges have been filed against an armed suspect wounded by an off-duty Waller County Sheriff's deputy at 5000 West Alabama about 1 a.m. on Wednesday (Jan. 24). 

The suspect, Jose Guadalupe Cortes (h/m, 35), is charged with aggravated assault of a police officer in the 176th State District Court.  He was transported to Ben Taub General Hospital where he was treated and released for wounds to his hand and shoulder.

The Waller County deputy who discharged his duty weapon was not injured in the incident.  

HPD Homicide Division Senior Police Officers E. Rodriguez, L. Bailey and Officers J. Snook and M. Millington reported:  

A  Waller County Sheriff's Office deputy was working an extra job at a construction site at an intersection near the above address.  The deputy saw a male (Cortes) drive a dark-colored SUV into the intersection and stop, impeding the flow of traffic.  When the deputy approached the vehicle and attempted to direct Cortes to proceed through the intersection, Cortes suddenly pulled out a gun and pointed it toward the deputy.  Fearing for his life, the deputy discharged his duty weapon, striking the vehicle and Cortes.  

Cortes drove to the 4700 block of Bellaire Boulevard and called 9-1-1.  Bellaire Police Department officers responded and were told by Cortes he had been shot and needed an ambulance.  Cortes was then transported to the hospital. 

As is customary in officer-involved shooting incidents occurring in the city limits, this case is being investigated by the HPD Special Investigations Unit and the Harris County District Attorney's Office.
