Officer-Invovled Shooting at 9220 East Avenue K

August 25, 2008 - Charges are pending against a suspect following a shooting that resulted in the wounding of the suspect at 9220 East Avenue K about 5:30 p.m. on last Friday (August 22).

The suspect, Miguel Benavides (H/m, DOB: 9-10-87), also known as Miguel Lopez, faces charges of possession of a controlled substance with intent to distribute. Benavides suffered a gunshot wound to the chest and was transported to Ben Taub General Hospital in critical condition.

Senior Police Officer S. E. Fisher, assigned to the Narcotics Division, was sworn in as an officer in July 1995. Officer Fisher, who discharged his service weapon, was not injured in this incident.

HPD Homicide Division Sergeant C. M. Cegielski and Officer B. W. Nabors reported:

HPD Narcotics officers arrived at the residence at 9220 East Avenue K, knocked on the door, identified themselves as police officers and announced they were executing a search warrant for the residence. After receiving no response, officers entered the residence and confronted Benavides, who refused to comply with officers’ commands to show his hands. Benavides then made an aggressive move towards officers with his hands. Fearing for his life and that of other officers, Officer Fisher fired his duty weapon and struck Benavides. Benavides was transported to the hospital. Officers later recovered a large amount of crack cocaine inside the residence.

As is customary with HPD officer-involved shootings in the city limits, the HPD Homicide and Internal Affairs Divisions and the Harris County District Attorney's office are investigating the incident.
