Investigators were called to LBJ Hospital about 11 p.m. on Nov. 28 regarding the death of a young boy. Garcia told investigators that earlier that day, his stepson (Jose) was having stomach pains. When Jose’s mother arrived home from work, she gave Jose some medicine. Later in the evening, Jose’s condition worsened and he was eventually taken to the hospital where he died.

An autopsy revealed Jose died of blunt force trauma to his abdomen. Upon learning that, investigators interviewed Garcia who admitted to hitting the child in the stomach. He was arrested at his residence without incident on Wednesday (Dec. 3).
