Suspect Arrested, Charged Incident at 8900 Imogene

December 7, 2009 - Charges have been filed against a suspect wounded by an HPD officer at 8900 Imogene about 1:05 a.m. today (Dec. 7).

The suspect, Nicholas John Schaefer (w/m, DOB: 7-29-65), received minor injuries and was transported to Memorial Hermann Southwest Hospital where he was treated and released into HPD custody. Schaefer is charged with filing a false report in Harris County Criminal Court #13.

Officer K. Waymire, who discharged his duty weapon, was not injured. He was sworn in as an HPD officer in June 2009 and is assigned to the Westside Patrol Division.

HPD Homicide Division Sergeant T. Biggs and Senior Police Officer B. Evans reported:

Westside patrol officers were dispatched to a report of a suspicious male armed with a weapon. Upon arrival, Officer Waymire took cover behind a tree and observed a male crouching beside a vehicle. Two additional patrol officers arrived on scene and observed Schaefer suddenly appear from behind a vehicle and verbally confront the three responding officers who had all taken cover near the intersection of Imogene and LaRoche.

Schaefer then approached the officers and suddenly appeared again, this time from behind a pickup truck. Holding a silver object in a two-handed grip, in such a manner as to make it appear he was holding a pistol, Schaefer raised what appeared to be a weapon in the direction of the officers. All three officers gave verbal commands to Schaefer to drop the weapon which he ignored. Instead, Schaefer again pointed the object in the direction of the officers, at which time Officer Waymire discharged his duty shotgun, wounding Schaefer in the arm.

As is customary when an HPD officer discharges a weapon in the city limits, this case will be investigated by the HPD Homicide and Internal Affairs Divisions as well as the Harris County District Attorney’s Office.
