Patrol officers responded to a robbery-with-weapons call at 9803 Club Creek and were flagged down by a male who said he had been carjacked by Acuna and believed he was in an apartment complex at 9803 Club Creek. Officer Polk confronted Acuna, who was still in the victim’s car, in the apartment complex parking lot. Acuna ignored repeated orders to give himself up and when he attempted to pull a loaded handgun from his waistband, Officer Polk discharged his duty weapon and struck Acuna in the abdomen. Acuna was taken into custody and then to the hospital.
