Suspect Charged, Wanted in Fatal Shooting at 10910 Gulf Freeway

November 21, 2011 - Charges have been filed against a suspsect wanted in the fatal shooting of one man and wounding of another at 10910 Gulf Freeway (South Interstate Highway 45) about 11 p.m. last Friday (Nov. 18).

The suspect, Johnathan Anthony Franklin (b/m, DOB: 8-16-89), is charged with murder and one count of aggravated assault in the 174th State District Court.  A photo of Franklin is not available for release at this time.

The deceased victim, Xaiver Rubio, 17, was pronounced dead at the scene.  A second victim, Ruben Rubio, 22, was wounded and transported to Ben Taub General Hospital with non life-threatening injuries.  The two victims are brothers.

HPD Homicide Division Sergeant C. Elliott and Officer M. Stahlin reported:

The two male victims were with a group of people on the sidewalk of an apartment complex at the above address when an unknown black male (suspect) walked by them.  The suspect came back a second time and an argument ensued.  At that time, the suspect pulled a pistol and began shooting.  Xavier Rubio, who was armed with a knife, suffered multiple gunshot wounds.  His brother, Ruben, managed to run several blocks where an ambulance was called to take him to the hospital.

Further investigation identified Franklin as the suspect in this case and he was charged.  He is not in custody.
