UPDATE: Suspect Arrested in Fatal Shooting at 10910 Gulf Freeway

January 31, 2012 - A suspect wanted and charged in the fatal shooting of one man and wounding of another at 10910 Gulf Freeway (Interstate Highway 45 South) service road about 11 p.m. on November 18, 2011, is now in custody.

The suspect, Jonathan Anthony Franklin (b/m, DOB: 8-16-89), is charged with murder and aggravated assault in the 174th State District Court in the fatal shooting of Xavier Rubio, 17, and wounding of his brother, Ruben Rubio, 22.

HPD Homicide Division Sergeant C. Elliott and Officer M. Stahlin reported:

The Rubio brothers were with a group of people on the sidewalk of an apartment complex at the above address when an unknown black male suspect walked by them.  The suspect came back a second time and an argument ensued.  At that time, the suspect pulled a pistol and began shooting.  Xavier Rubio, who was armed with a knife, suffered multiple gunshot wounds and died at the scene.  His brother, Ruben, managed to run several blocks where an ambulance was called to take him to Ben Taub General Hospital where he was treated for his injuries.

Further investigation identified Franklin as the suspect in this case and he was charged two days later.

Investigators received information that Franklin was at a Pasadena apartment complex at 3271 Shaver.  Officers with the HPD Crime Reduction Unit went to the location on Monday (Jan. 30) and arrested him without incident.
