Suspects Arrested, Charged in Incident at 5458 North Freeway

May 26, 2015 - Charges have been filed against two suspects in relation to an incident in which an off-duty Harris County Sheriff's Office deputy discharged his duty weapon at 5458 North Freeway (North Interstate Highway 45) about 12:45 p.m. on Saturday (May 23).

Suspect Christopher Quintana (H/m,34) is charged with theft in the 208th State District Court.  Suspect Ryan C. Pogue (w/m, 25) is charged with evading arrest, also in the 208th State District Court.   Photos of these suspects are not available at this time.

The Harris County Sheriff's deputy who discharged his duty weapon was not injured in this incident.
HPD Homicide Division Sergeant M.A. Holbrook and Officer K. McDonald reported:

A Harris County Sheriff's deputy, in full uniform because he had just left an extra job, came to the above address (Radio Shack) to shop.  As he was walking toward the entrance, the deputy observed suspect Quintana running out of the store carrying an armful of merchandise.  The deputy, believing a robbery or burglary had just occurred, gave Quintana verbal commands to stop.  Quintana ignored those commands and instead ran past the deputy and dove through the driver's side window of a Ford Mustang backed into a handicapped parking space.

The deputy then saw the vehicle accelerate toward him and attempted unsuccessfully to move out of the way. He was struck slightly by the vehicle and discharged his duty weapon more than one time, striking suspect Quintana, who was lying across the lap of the driver (suspect Pogue).  Pogue then stopped the vehicle and was taken into custody without incident.

Suspect Quintana was transported to Ben Taub General Hospital with non life-threatening wounds.  Both suspects were subsequently charged in this incident.

As is customary when a law enforcement officer discharges a duty weapon in the city limits and strikes a suspect, this case will be investigated by the HPD Homicide Division and Harris County District Attorney's Office.
