Incident at 5700 South Loop East

April 18, 2007 - Charges have been filed against two men in the aggravated assault on a police officer at 5700 South Loop East about 3:30 p.m. on Tuesday (April 17).

The suspect, Hugo DeLaRosa Garcia (H/m, DOB: 12-09-79), is charged with aggravated assault against a public servant and theft in the 174th State District Court.

The second suspect, Daniel Biaez (H/m, DOB 09-06-75), is charged with theft in the 174th State District Court.

HPD Homicide Division Sergeant J.H. Roberts and Officer L.K. Lovelace reported:

HPD officers were conducting an auto theft sting operation when they observed Garcia and Biaez stealing tires from a vehicle and load them into Garcia’s vehicle, a Ford van. Officers arrested Biaez without incident; however, Garcia attempted to flee by backing his van into one of the officer’s vehicle. Garcia then sped forward towards other officers placing them in danger and striking a pole. As Garcia attempted to back up for a second time with the officers and suspect Biaez in his path, Officer G.A. Flowers, a 27-year veteran, fearing for the safety of the officers and the arrested suspect (Biaez), fired one shot into the passenger side front tire of Garcia’s van. Officer R. Carr, a 15-year veteran, fearing that the suspect was going to strike Officer Flowers others, fired three times through the rear window of the vehicle. Garcia continued to drive forward until his vehicle got stuck. He then surrendered without further incident. There were no injuries sustained in this incident.

As is customary in officer-involved shootings in the city limits, the case is being investigated by the HPD Homicide and Internal Affairs Divisions and the Harris County District Attorney’s Office.
