Investigation into Fatal Shooting at 3100 Napoleon


July 21, 2016 - The fatal shooting of a man that occurred at 3100 Napoleon about 4:35 a.m. on Wednesday (July 20) will be referred to a Harris County grand jury.

The victim, Demarcus Tucker, 33, was pronounced dead at the scene.

HPD Homicide Division Sergeant T. Simmons and Officer S. Overstreet reported:

According to the shooter, he was driving in the 3rd Ward area near downtown about 4 a.m., attempting to sell drugs.  While waiting in his truck at the corner of Rosalie and Napoleon, he was approached by Mr. Tucker.  At some point during the encounter, Tucker reached inside the truck and attempted to take shooter's gun.  The two men began struggling over the weapon, which discharged, striking Tucker in the face.  The shooter then fled the scene.

About 90 minutes later, the shooter was seen driving by the location and was taken into custody.  Because of the circumstances involved and conflicting witness statements, the case will be referred to a Harris County grand jury.
